By consenting to Compound’s SMS/text messaging service, you agree to receive recurring automated marketing and service text messages (e.g., order updates, cart reminders, offers) at the mobile number you provided, including via automatic telephone dialing systems. Consent is not a condition of any purchase. Message frequency varies, and message and data rates may apply. You can opt out at any time by replying STOP to any message, or reply HELP for help. We are not liable for delayed or undelivered messages. Our SMS program is operated with the help of Klaviyo; see our Privacy Policy for how we handle your information.

Online Store Terms

By agreeing to these Terms, you represent that you are at least the age of majority in your state of residence, or that you have given us consent for any minor dependents to use this site. Accounts & Registration

Some features require an account. We may suspend or terminate accounts that violate these Terms or are used for fraud or abuse.

Promotions & Gift Cards

Promotions, discount codes, and member offers are subject to their stated terms, may be changed or ended at any time, cannot be combined unless we say so, carry no cash value, and cannot be applied retroactively. Gift cards, if offered, are redeemable only toward purchases on the Site, are not refundable or exchangeable for cash except where required by law, and we are not responsible for lost or stolen gift cards.

Electronic Communications

By using the Site or contacting us, you consent to receive communications from us electronically — by email, by text where you have opted in, and through notices posted on the Site — and you agree these satisfy any legal requirement that such communications be in writing.

Force Majeure

You are prohibited from using the site or its content for any unlawful purpose; to solicit unlawful acts; to violate any regulations or laws; to infringe our or others’ intellectual property; to harass or discriminate; to submit false information; to upload malicious code; to collect others’ personal information; to spam, phish, or scrape; or to interfere with the security of the Service. You agree to indemnify, defend, and hold harmless Compound Active and its affiliates, officers, employees, and suppliers from any claim or demand, including reasonable attorneys’ fees, arising out of your breach of these Terms or your violation of any law or third-party right.

Arbitration & Class Waiver

Please read this section carefully — it affects your rights. Any dispute arising from or relating to these Terms, our marketing, our products, or our relationship will be resolved by binding, individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, governed by the Federal Arbitration Act. Disputes will be resolved on an individual basis; class or representative actions are not permitted. You may opt out of arbitration within 30 days of your first purchase by emailing support@compoundactive.com with your name and a clear statement of your intent to opt out of arbitration.

Termination

These Terms are effective unless and until terminated by either you or us. Obligations and liabilities incurred prior to termination survive. If you fail to comply with any term, we may terminate this agreement at any time without notice, and you will remain liable for all amounts due.

Governing Law

These Terms and any separate agreements by which we provide you Services are governed by the laws of the State of Texas and applicable U.S. federal law, without regard to conflict-of-law principles.
